1. Introduction
These Terms and Conditions (“Terms”) govern the provision of motorcycle servicing, repairs, parts, and accessories by Resvier Motorcycles (“we”, “us”, “our”) to you (“the Customer”). By booking a service, dropping off your vehicle, or purchasing goods from us, you agree to be bound by these Terms.

These Terms do not affect your statutory rights under UK law.

2. Definitions

  • “Goods” means any motorcycle parts, accessories, helmets, or riding gear sold by us.

  • “Services” means any minor or major motorcycle servicing, engine rebuilds, diagnostics, or accident management support provided by us.

  • “Workshop” means our premises located at 3A Moselle Place, Tottenham, London N17 8DG.

3. Estimates and Quotations

  1. Diagnostic Fee: We offer a free initial diagnostic check. However, if a detailed strip-down or specialist testing is required to identify a fault, a diagnostic labour charge may apply. We will inform you of this before proceeding.

  2. Quotations: All written quotations are valid for 30 days from the date of issue, unless otherwise stated.

  3. Variations in Work: If during the repair process we discover additional work is required that was not included in the original estimate, we will contact you to obtain your express authorization before proceeding. We reserve the right to charge a re-inspection fee if you decline the additional work after the motorcycle has been partially dismantled.

  4. Authorisation: By dropping off your motorcycle or leaving it with us, you authorize us to carry out any routine work (e.g., oil changes, safety checks) that falls within the agreed scope of the original estimate.

4. Payment Terms

  1. Full Payment: The full balance for all Services and Goods is due upon the collection of your motorcycle, unless a credit account has been agreed in writing prior to the work.

  2. Accepted Methods: We accept Cash, Card (Debit/Credit), and Bank Transfer.

  3. VAT: All prices displayed are inclusive of VAT at the prevailing UK rate, unless explicitly stated otherwise.

  4. Accident Management: For McAMS accident management claims, payment terms are governed by the agreement between you, your insurer, and Direct Accident Management Ltd (FCA regulated). We act as an agent on their behalf.

5. Warranty and Liability

  1. Labour Warranty: We warrant that all Services will be performed with reasonable skill and care. Any labour provided by us is guaranteed for 3 months or 1,000 miles (whichever comes first) against defects arising from our workmanship.

  2. Parts Warranty: All genuine Honda and Yamaha parts supplied by us are covered by the manufacturer’s original warranty (typically 12 months, subject to manufacturer terms). Non-genuine parts or accessories carry the manufacturer’s standard warranty only.

  3. Customer-Supplied Parts: We accept no liability or warranty for any failures resulting from parts, oils, or consumables supplied by the Customer.

  4. Consequential Loss: To the fullest extent permitted by law, we shall not be liable for any indirect, consequential, or incidental damages, including but not limited to loss of income, loss of business, loss of use of the motorcycle, or travel expenses incurred during the repair period. You are advised to arrange alternative transport or insurance cover for these eventualities.

  5. Customer Property: We are not responsible for any personal items left inside your motorcycle’s top box, panniers, or storage compartments. Please remove all valuables before leaving your bike with us.

6. Vehicle Storage and Collection

  1. Collection Period: You must collect your motorcycle within 7 working days of being notified that the work is complete.

  2. Storage Charges: If your motorcycle remains uncollected for more than 7 days after our final notification, we reserve the right to charge a storage fee of £10.00 per day (inc. VAT) to cover the cost of secure storage and administrative handling.

  3. Abandoned Vehicle: If the vehicle is not collected within 30 days of the completion notice and the outstanding balance remains unpaid, we reserve the right to sell the vehicle to recover our costs, following the formal procedure outlined in the UK Torts (Interference with Goods) Act 1977. We will provide 14 days’ written notice prior to any disposal.

7. Cancellation and Refunds

  1. Cancellation of Service: You have the right to cancel a service booking up to 48 hours prior to the scheduled appointment without charge. Cancellations made less than 48 hours before the appointment may incur a cancellation fee of £50.00 to cover lost workshop time.

  2. Consumer Right to Cancel: Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you order Goods or Services online or over the phone, you have a statutory right to cancel within 14 days. However, this right does not apply if we have already fully completed the Service (e.g., repaired your motorcycle) with your consent before the 14-day period ends.

  3. Refunds: Refunds for uninstalled parts will be processed within 14 days of receiving the returned item. Parts must be returned in their original packaging and unused condition. Parts that have been fitted or special-ordered specifically for your motorcycle are non-returnable.

8. McAMS Accident Management
Where we act as your approved McAMS dealer for accident management, we will assist you with the recovery, repair, and claims process. We act as an agent in this capacity. The ultimate terms of the claim, including liability, excesses, and approval of repairs, rest with your insurer and Direct Accident Management Ltd.

9. Data Protection
We will collect, store, and process your personal data in accordance with our Privacy Policy, available on our website. By using our services, you consent to the processing of your data as outlined therein.

10. Complaints Procedure
We aim to resolve all disputes amicably. Should you have a complaint regarding our Services or Goods, please contact us immediately at 07902 331054 or resviermotorcycles@gmail.com.
If the complaint cannot be resolved, you have the right to contact the Motor Ombudsman, the official dispute resolution body for the automotive sector in the UK.

11. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
